This is a repeat of the highly successful lecture given at Middle Temple in February.

The application of the Sentencing Council’s Guideline regarding harm appears to be a difficult area for both Judges and lawyers.

This presentation will consider the case law and how to approach the following:

  • The seriousness of harm risked by the offender’s breach
  • The likelihood of that harm arising
  • Whether the offence exposed a number of workers or members of the public to the risk of harm
  • Whether the offence was a significant cause of actual harm
