This is a repeat of the highly successful lecture given at Middle Temple in February.
The application of the Sentencing Council’s Guideline regarding harm appears to be a difficult area for both Judges and lawyers.
This presentation will consider the case law and how to approach the following:
- The seriousness of harm risked by the offender’s breach
- The likelihood of that harm arising
- Whether the offence exposed a number of workers or members of the public to the risk of harm
- Whether the offence was a significant cause of actual harm
The speakers
James Ageros QC works exclusively in Health and Safety and Environmental Law practising from Crown Office Chambers. He co-authors the book Health and Safety Enforcement and Law and Practice with Richard Matthews Q.C. He prosecutes and defends in health and safety cases and has been recognised in legal directories as one of the most accomplished barristers in the field for many years.
Valerie Charbit was appointed to the A list of Specialist Regulatory Advocates in Health and Safety in 2012. She prosecutes and defends in health and safety cases. She has a broad practice in other criminal work including serious fraud, serious sexual offences, professional disciplinary work and mental health. She is a member of Red Lion Chambers.
