The Shoreham air disaster prosecution & its aftermath

This presentation is given by Tom Kark QC and Kerry Broome who were instructed by the CPS in the prosecution of Andrew Hill, the pilot involved in the Shoreham air show disaster. It will include the following:

  • The charging and the legal issues pre indictment
  • Counsels’ dealings with the bereaved
  • The way the prosecution put the case
  • The ‘bad character’ evidence
  • The defence case
  • The legal challenges on securing the evidence
  • The expert evidence on each side
  • The wider effect of the verdicts

Tom Kark QC. Tom’s work originated in criminal law and he developed a practice prosecuting and defending white collar criminal cases and serious crime. In 2002 Tom was appointed Standing Counsel to HM Revenue and Customs and undertook their most serious and complex prosecutions and for the Serious and Organised Crime Agency. In the early 2000s he began acting for a number of regulatory bodies and their registrants. In 2010 he was appointed counsel to the Public Inquiry into Mid Staffordshire NHS Foundation Trust Chaired by Robert Francis QC (later Sir Robert Francis).

Tom continues to practise criminal law and has undertaken a number of health and safety prosecutions including offences involving allegations of gross negligence manslaughter. In 2018-2019 Tom was appointed by the Health Secretary to undertake a review of the Fit and Proper person test under regulation 5 of the Health and Social Care Regulations. In 2018 he was instructed to prosecute Mr Andrew Hill, the pilot of the Hawker Hunter jet involved in the Shoreham air show disaster.

Kerry Broome. Kerry has experience of the most serious criminal offences as both a prosecution and a defence advocate.  She is instructed as leading junior, led junior and sole counsel. Her cases often involve complex and sensitive evidence.  She has knowledge of every stage of proceedings and is recognised in particular for her excellent advocacy.  Kerry is a Treasury Counsel Monitoree and as such deals with the most complex, media sensitive and grave matters.

Kerry has an abundance of experience acting on behalf of professionals and for regulators across a variety of industries, including education, law enforcement, finance and healthcare.  She has experience of a wide range of hearing category and of various stages in the process.  She has great understanding of the industries she operates in, applies excellent judgement, is phenomenally hard-working and gets fantastic results.
